New York State has become the first in the United States to officially introduce strict temporary restrictions on the construction of massive new data processing facilities. The rapid development of generative artificial intelligence and cloud computing has forced government officials to act proactively. The growth of resource consumption threatens the stability of energy supply and the ecological balance of the region. The new decree establishes a one-year moratorium on issuing permits for the construction of ultra-large-scale facilities whose power consumption exceeds established limits.
The main task of this step is to conduct a detailed analysis of the load on local networks and to develop new environmental regulations. While the AI industry demands more and more computing power, ordinary consumers risk facing increased utility rates and unstable power grid operation during peak periods. The temporary pause will allow specialists to assess the real risks and create rules of the game that will protect the interests of state residents.
Strict Restrictions and Moratorium Framework
All promising projects of computing centers with a planned power consumption exceeding 50 MW fall under the new rules. These are giant complexes that usually serve multinational corporations and large-scale machine learning models. The moratorium will be in effect for exactly one year, during which relevant agencies must prepare a comprehensive report on the industry’s impact on the state’s ecology.
The ban does not apply to facilities that have already received all necessary permits and are under active construction, nor does it apply to small local server rooms of the corporate sector. The main goal of legislators is to curb the uncontrolled expansion of so-called hyperscale sites that consume as much electricity as small industrial cities.
Energy Pressure and Threat to the Grid
Modern data centers consume a colossal amount of energy, not only to run processors but also to power complex cooling systems. According to experts, a single query to modern artificial intelligence systems requires several times more electricity than a standard search query online. Rapidly connecting dozens of new gigawatts of capacity creates critical conditions for infrastructure built decades ago.
In New York, there are concerns that excessive demand from tech giants will force the reactivation of old fossil-fuel power plants. This would completely derail the state’s plans to transition to renewable energy sources and reduce carbon emissions. Furthermore, the generation deficit will inevitably lead to higher wholesale electricity prices, which will directly affect the bills of ordinary citizens.
The Problem of Colossal Water Consumption
In addition to the load on the power grid, data centers are among the largest consumers of fresh water. They use it in evaporative cooling towers to cool racks with hot circuit boards. During summer months, water evaporation volumes at a single large facility can reach millions of liters per day. This poses a direct threat to local aquifers and municipal water supply systems.
The new law requires the development of closed-loop cooling systems that minimize water loss. Researchers plan to set strict limits on the use of potable water for technological needs. Companies will have to switch to using treated wastewater or implement more expensive dry air cooling systems, which will significantly increase construction costs.
Finding a Balance Between Innovation and Safety
Technology industry representatives have already expressed concern about the state government’s decision. They argue that a one-year pause could lead to an outflow of investment to neighboring regions where environmental standards are less stringent. However, supporters of the moratorium emphasize the importance of long-term planning. The safety of cities and the stability of critical infrastructure have absolute priority over quick corporate profits.
The results of the one-year study are expected to form the basis of a new environmental code for the IT sector. New York is trying to set a precedent and show an example to other states also facing the challenges of rapid digitization.
